IESO microFIT Contract Assignee’s Declaration

If you are planning on taking on an Independent Electricity System Operator (IESO) microFIT contract, you will be required to complete an Assignee's Declaration form. Your Neighbourhood Notary can help you commission your completed form.

Ontario's microFIT program was started in 2009 and encourages small renewable energy projects by suppliers by guaranteeing a fixed price for energy over a 20-year term.

The IESO microFIT Contract Assignee's Declaration is a form that needs to be completed in order for a current supplier to assign a microFIT contract to a new supplier. Situations where a Contract assignment request may be submitted to the IESO include: 
  • Sale of property
  • Adding or removing a party from the contract
  • An event causes the supplier to no longer be an eligible participant and the contract needs to be assigned to an eligible participant

The new supplier must also meet the criteria listed in the applicable microFIT Eligible Participant Schedule in order for the IESO to provide their consent to the contract assignment.

Why is it Required? 

When a current supplier wishes to transfer their contract (and all of their rights and obligations) over to a new supplier, they must complete the Assignee's Declaration as required by the IESO. The purpose of the declaration is to ensure that the microFIT Contract Assignment Request is actually being submitted by the assignee (the new supplier who wants the contract to be assigned to them/it), and not a third party. 

Commissioning Your IESO microFIT Contract Assignee's Declaration 

You will need to fill out the form and sign it, in the presence of a commissioner or notary public. If there is more than one assignee applying for contract assignment, a separate Assignee’s Declaration form must be submitted for each applicant.
