What is it? 

The Statutory Declaration of Common-Law Union form (IMM 5409) is used by those who wish to claim their common-law partner in their immigration-related application. 

The form can be used as part of a variety of applications:

Are we considered Common-Law?

In the immigration context, a common-law partnership means that a couple has lived together for at least one (1) year in a conjugal (a relationship of some permanence and interdependence) relationship. It starts from the day on which the two individuals can provide evidence / supporting documents to support their cohabitation in a conjugal relationship.
