What You Need to Know About Online Commissioning
1. What is the difference between online notary service and online commissioner of oath service?
In Ontario, notary public / commissioner of oaths are allowed to complete or witness certain documents, such as administering and taking of oaths, if certain requirements are met. This is called online commissioning. Notary publics in Ontario witness the execution of documents, certify true copies of documents, etc. This is called notarization or notarizing. In Ontario, this must be done in-person and cannot be signed online. Therefore, your Neighbourhood Notary does not offer online notary services. Your Neighbourhood Notary offers online commissioner of oath services only. Learn more here. 2. Not every document can be commissioned online. Practically speaking, there are limits to online or remote commissioner of oath services because not all documents can be commissioned online. Some documents that we regularly commission online:
Generally, we do not recommend online commissioning for documents where the final destination is outside of Ontario. Ultimately it is up to you to make sure the receiving organization will accept a document that is commissioned online. Contact us to see if we can help commission your document online! |
3. There are requirements.
4. You do not have to be in Ontario. Subsection 45(2) of the Ontario Evidence Act provides that an affidavit sworn outside Ontario before a commissioner for taking affidavits in Ontario has the same effect as if the affidavit had been sworn in Ontario. |
